State wants pause in free speech suit pending injunction appeal

A judge granted the AIDS Healthcare Foundation a preliminary injunction in November, saying it was likely to succeed on its claims that a contract with the state health care department was canceled because the group sent unsanctioned notices to patients.

The California Department of Health Care Services asked a federal judge on Thursday to stay a lawsuit alleging free speech violations pending an appeal of a preliminary injunction.

The lawsuit filed against the agency last year accused it of voiding a contract because of comments made by an AIDS advocacy foundation.
